GoBackload Sender Terms & Conditions
1. Introduction
These Terms and Conditions (“Terms”) apply to your use of the GoBackload platform as a sender of freight (“Sender”).
By accessing or using the GoBackload website or services, you confirm that you have read, understood, and agree to be bound by these Terms.
If you do not agree, you must not use the Platform.
2. Nature of the Service (Important)
GoBackload is a technology platform only.
We:
- Connect Senders with independent carriers (“Truckies”)
- Facilitate communication and booking
- May facilitate or hold payments
We do not:
- Transport goods
- Act as a freight carrier
- Control or manage carriers
- Guarantee service outcomes
👉 All transport services are provided directly by the Carrier to the Sender.
Any agreement for freight services is strictly between you and the Carrier, not GoBackload.
3. No Liability for Freight Services (Critical Protection Clause)
To the maximum extent permitted by law:
GoBackload accepts no responsibility or liability whatsoever for:
- Loss, theft, or damage to goods
- Delays or failure to deliver
- Missed pickups or timing issues
- Misrepresentation by carriers
- Poor service or bad experiences
- Injury, accident, or incident during transport
- Any dispute between Sender and Carrier
This applies even where GoBackload:
- Facilitates the booking
- Holds or processes payment
- Suggests or matches a Carrier
- Provides pricing guidance
👉 GoBackload is not a party to the transport contract and bears no transport risk.
4. Payments (Important Clarification)
GoBackload may:
- Collect, hold, or transfer funds on behalf of users
- Provide a safer and faster booking process
However:
👉 This does NOT make GoBackload responsible for the transport service.
- Payment facilitation does not create liability
- Payment holding does not guarantee service delivery
- Payment processing does not make GoBackload a carrier or agent
Any issues relating to:
- Service quality
- Delivery performance
- Damage or loss
must be resolved directly with the Carrier.
5. Sender Responsibility
You are responsible for:
- Providing accurate and complete load information
- Ensuring your goods are properly packaged
- Confirming carrier suitability before accepting an offer
- Reviewing the Carrier’s terms, insurance, and capabilities
You acknowledge that:
- Incorrect or misleading information may affect pricing and service
- Special requirements (fragile, oversized, hazardous, etc.) must be disclosed
6. Insurance
You are responsible for ensuring your goods are adequately insured.
- GoBackload does not provide insurance
- Carriers may have limited liability cover
- Standard carrier cover may be significantly lower than the value of your goods
👉 You must confirm insurance directly with the Carrier before booking.
7. Accept-Now Bookings
- You may suggest a price using the “Accept-Now” feature
- A Carrier may accept or decline your price
- A booking is only confirmed once both parties agree
GoBackload:
- Does not guarantee acceptance
- Does not guarantee performance after acceptance
8. Cancellations & Refunds
Cancellations are handled between the Sender and the Carrier.
GoBackload:
- Does not guarantee refunds
- Is not responsible for cancellation outcomes
- May assist administratively but is not liable
9. Ratings & Reviews
You may leave ratings and reviews.
GoBackload:
- Does not verify user content
- Is not responsible for accuracy of reviews
- May remove content at its discretion
10. Account Responsibility
You agree to:
- Provide accurate account information
- Keep login details secure
- Be responsible for all activity under your account
11. Limitation of Liability
To the maximum extent permitted by law:
GoBackload’s total liability to you (if any) is limited to:
👉 The amount paid by you through the platform for the specific transaction
GoBackload will not be liable for:
- Indirect or consequential loss
- Loss of profit or opportunity
- Emotional distress or inconvenience
12. Indemnity
You agree to indemnify and hold harmless GoBackload from any:
- Claims
- Losses
- Damages
- Legal costs
arising from:
- Your use of the platform
- Any dispute with a Carrier
- Any breach of these Terms
13. Security
While we use industry-standard protections:
- We cannot guarantee absolute security
- We are not responsible for unauthorised access
14. Termination
GoBackload may suspend or terminate your account:
- At any time
- Without notice
- For any reason
15. Changes to Terms
We may update these Terms at any time.
Continued use = acceptance of updated Terms.
16. Governing Law
These Terms are governed by the laws of New Zealand
